What to Know
- Research enumerated in the USML under ITAR is not considered fundamental when it occurs outside an accredited institution of higher learning in the US
- Research enumerated in the CCL under EAR is considered fundamental in any setting if there are no publication restrictions and no restrictions on who can participate in the research
- Regulations differ between off-campus research within the US and off-campus research outside the US
Examples of Off-campus Research Subject to Export Control Restrictions
- MIT researchers working on research technology topics enumerated on the USML at a commercial lab
- Researchers design a circuit board under fundamental research conditions. They send it to be manufactured by a commercial company who slightly modifies the design. The circuit board as manufactured is now controlled under EAR.
Examples of Off-campus Research Not Subject to Export Control Restrictions
- MIT researchers working on fundamental research at a commercial lab if there are no publication restrictions and no restrictions on who can participate in the research
- MIT researchers working on fundamental research in Russia if there are no publication restrictions and no restrictions on who can participate in the research
